Agreement between User and SandDollarApps LLC

Welcome to https://www.lingowise.ai. The website (the "Site") is operated by SandDollarApps LLC ("LingoWise"). The Site helps language learners build vocabulary and conversational fluency through AI-powered practice. The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Please read these terms carefully.

AI-Generated Content Disclosure

LingoWise offers both online and offline functionality. Conversation practice with the AI Tutor requires an internet connection and is powered by Google Gemini AI. Translation and text-to-speech work both online (via Google Cloud APIs) and offline (using local browser-based AI models). This means you can collect vocabulary and practice pronunciation in Study mode without an internet connection. While we strive for accuracy, AI-generated content may occasionally contain errors. All material is intended for educational purposes only. We encourage you to verify important translations independently.

Membership Tiers

Free Members: Access core features including vocabulary translation, study mode with pronunciation practice, and AI conversation practice. All data is stored locally in your browser. Important: Clearing your browser cache will also clear your packs and cards. Your data is only accessible on the device where you created it.

Pro Members: Everything in Free, plus:
• Unlimited cloud storage for your vocabulary packs and cards, so your work is protected
• Conversational context saved so the AI Tutor remembers you and delivers a bespoke experience
• Progress history and learning analytics tracked over time
• Cross-device access to your data

The AI Tutor uses your active vocabulary pack as context. It weaves your words into natural conversation while introducing related new vocabulary to help you grow.

Pro Member subscriptions automatically renew monthly unless cancelled or suspended. You may cancel at any time through your account settings and retain access through the end of your billing period. You may also suspend your subscription to pause payments while keeping your cloud data intact. This is perfect for breaks between learning. Payment processing is handled securely through Stripe, and we do not store your payment card details.

Privacy

Your use of the Site is subject to LingoWise's Privacy Policy. Please review our Privacy Policy, which informs users of our data collection practices. We respect your privacy and are committed to protecting your personal information.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you suspect any unauthorized use. We reserve the right to suspend or terminate accounts that violate these terms or engage in harmful behavior.

Acceptable Use

LingoWise is designed to help you learn languages. Please use it responsibly and lawfully. Misuse of the service, including any activity that violates applicable laws or interferes with other users, may result in account termination. We reserve the right to enforce usage limits to ensure fair access for all users.

Intellectual Property

The Site design, features, functionality, and user experience are owned by SandDollarApps LLC and are protected by copyright, trade secret, and other intellectual property laws. Vocabulary translations and conversation responses are generated dynamically using AI and are provided for your personal educational use only. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or otherwise attempt to discover the source code, algorithms, or business methods embodied in our service without prior written permission. Any unauthorized use terminates the permissions granted herein and may result in legal action.

Limitation of Liability

LingoWise is provided "as is" and "as available" without warranties of any kind. We do our best to provide accurate and helpful content, but we cannot guarantee perfection. To the maximum extent permitted by law, SandDollarApps LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you've paid for the service in the past twelve months.

Indemnification

You agree to defend and hold harmless SandDollarApps LLC from any claims, damages, or expenses arising from your use of the Site or violation of these Terms. We're here to help you learn, and we ask that you use our service responsibly.

Children under Thirteen

LingoWise does not knowingly collect personal information from persons under the age of thirteen. If you are under 13, please do not use this service.

Electronic Communications

By using our Site or communicating with us electronically, you consent to receive communications from us electronically. We may communicate with you by email or by posting notices on the Site.

Changes to Terms
